Terms of Service

Effective

The short version

1. Who we are

Takefox (the “Service”) is operated by (“we”, “us”). You can reach us at or .

By creating an account or using the Service you agree to these Terms, our Privacy Policy and our Refund Policy. If you use the Service for a business, you confirm you can accept these Terms on its behalf.

2. Your account

3. What the Service does

You describe a video in your own words, optionally add photos of a product or character, and the Service generates preview images (“first frames”). You can pick one and turn it into a short video clip. To do this we send your text and photos to third-party AI models, currently Seedream and Seedance (ByteDance) and Kling (Kuaishou) for images and video, and OpenAI GPT models for understanding requests and reviewing previews, accessed through the APIPod platform, with fal as a backup. We may change models, features and limits over time.

AI output can be unexpected, inaccurate or similar to what other people receive. Review everything before you publish it.

4. Plans, credits and payment

5. Your content

“Inputs” are the text and photos you give us. “Outputs” are the images and videos generated for you.

6. Acceptable use

You must not use the Service to create, upload or share:

When you upload photos of people, you confirm you have their permission. When you upload photos of products or characters, you confirm you have the right to use them.

You also must not try to get around usage limits or safety filters, access the Service with bots or scrapers, resell access to it, or interfere with its operation. We and our AI providers may block requests, remove content, and suspend or close accounts that break these rules.

7. Labelling AI content

Many platforms and laws (for example TikTok, YouTube and Instagram policies, and the EU AI Act) require you to disclose realistic AI-generated content. You’re responsible for labelling your posts where required. Don’t remove information that identifies content as AI-generated.

8. Third-party services

The Service depends on third parties such as our AI providers, APIPod, fal and Creem. Their own terms may apply, and we’re not responsible for their outages or changes, though we’ll do our best to keep the Service running.

9. Ending your use

You can stop using the Service and ask us to delete your account at any time by emailing . We may suspend or close your account if you break these Terms, if required by law, or if we discontinue the Service. If we discontinue the Service, we’ll give you at least 30 days’ notice and refund the unused part of any prepaid subscription. If we close your account because you broke these Terms, unused credits are forfeited.

10. Disclaimers

The Service is provided “as is” and “as available”. To the extent the law allows, we make no promises that the Service will be uninterrupted or error-free, or that Outputs will be accurate, original, fit for a particular purpose, or free from third-party rights.

11. Limitation of liability

To the extent the law allows, we aren’t liable for indirect, incidental or consequential losses, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and USD 100. Nothing in these Terms limits liability that can’t be limited by law, or your statutory rights as a consumer.

12. Indemnity

If someone brings a claim against us because of your Inputs, your use of Outputs, or your breach of these Terms, you’ll cover our reasonable costs and losses, unless the law where you live doesn’t allow this for consumers.

13. Changes to these Terms

We may update these Terms. For material changes we’ll notify you by email or in the app at least 14 days before they take effect. If you keep using the Service after that, the new Terms apply; if you don’t agree, you can cancel before they take effect.

14. Governing law

These Terms are governed by the laws of . If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.
